..."We face a problem similar to one that recently confronted the Court of Appeal for Ontario, the highest court of that Canadian province, when it considered the constitutionality of the same-sex marriage ban under Canada's Federal Constitution, the Charter of Rights and Freedoms," it wrote.

"In holding that the limitation of civil marriage to opposite-sex couples violated the Charter, the Court of Appeal refined the common-law meaning of marriage," it said.

"We concur with this remedy."

    This actually comes at a bad time. Why?

    It seems it will give the US republican party something to rally around come election time. They will try to use it to deflect criticism of the rest of their actions. We can see how here in Canada how it has been so divisive, down south - it will be amplified and abused for political gain.

    Yeah, i see what you`re saying, but to improve and guarantee the rights of all humans can never come at a bad time! I commend the backbone that the government of Massachussets is showing, especially in these times! I also sense that the Republicans will have to fix another election in order to win!

    I\'ve been following the same sex marriage debate and I fail to see how it is a human rights issue. Can someone please tell me how the basic human rights of those in the gay and lesbian communities are hindered in the absence of state recognition of same sex marriage? As far as I can see it more an issue of spousal benefits and little to do with human rights.
