Canadian Supreme Court Rules Against Saskatchewan Farmer

Today, the Canadian Supreme Court ruled in favour of Monsanto Canada against Saskatchewan farmer Percy Schmeiser. Schmeiser allegedly had Monsanto's patented genetically modified Canola seeds illegally planeted on his property because they had been blown in from another farmer's field. The court dropped the $200,000 in legal fees and damages Monsanto had initially brought against Schmeiser, however, the results of the case still have grave reprecussions for Canadians and Canadian farmers.

    90% of this guy's field was found to be planted with Monsanto seed, the idea that the seeds just blew in and planted themselves is a bit ludicrous. He was stealing a patented product in order to produce a higher quality crop and he got caught - too bad for him.

    Not ludicrous at all, when I neglect my flower garden for a couple days, wierd things start to pop up! Point is, corporate fascists have no business owning patents on lifeforms! If we allow this, we`re all screwed!!!

    There are so many things that make me angry about this topic.

    1. What were farmers thinking when they decided to seed Monsanto crops anyway? About the bottom line? Our intentions most often will be a predicator for the outcome of a situation. I'm mad at the farmers for their misguided intensions.

    2. We have to stop businesses from patenting life on the planet. Each of us will be wearing patent tags on our ears like cattle one day. Patented foods MUST be labelled GMO because by the act of patenting them you're admitting they are not natural. If you argue they are natural then you by law are not allowed to patent them? So, again, where is our judicial system on this? And, no labelling is required.

    3. Canola is no longer a natural crop. It is so polluted health food stores can no longer guarantee organic canola. Farmers must not grow GMO crops. What will it take to get them to see that?

    4. What's with the Supreme Court making this decision while making the opposing decision with regards to the mouse? What's happening to our judicial system?

    The only sneaky ones in this horrible story are monsanto. And our supreme court is just as stupid as the American supreme court. Both put corporate interests first.

    Dave's exactly right! It reminded me of what happened in the USA with that bacteria that eats oil slicks. There was some argument between the US Patent Office and something else about whether it was possible to patent a lifeform, and it got patented. Not only some DNA or anything, but an actual lifeform; it got classed as a 'substance' that eats oil, it's not bacteria according to the patent! This was some pretty bad news we got today... I think CBC or somebody on CBC was saying that GM foods should definitely be an election issue, and I agree.

    Yes, I think that corporations would like to patent, anything and everything so that we are totally dependant on them for our own lives!

    If you have a plot of land on which you are planting traditional, non GMO crops of which you save your own seeds to plant the following year, and across the road Genetically Modified crops of closely related species are being grown, your seeds are guaranteed to be contaminated by/with that crop, that GM material.

    In the following generations of your crop, even in the event that there were no other related crops to influence your genetic material farther, your crop will increasingly express this genetic trait, as it happens to be placed as a dominant gene.

    It is very likely that Percy Schmeiser’s crop is contaminated by Monsanto’s property, and that they are liable to clean up the pollution they have created, and not just in this situation, but around the world.

    I question that it is a more profitable crop. It is resistant to Roundup, which allows for a different approach to weed control, but as I understand the situation, this trait was not taken advantage of by Mr. Schmeiser, and as such is no advantage at all, just a genetic pollutant. It stands to reason that his crop would be 100% GM if he had been taking advantage of this trait.

    No, Percy didn’t steal anything from Monsanto, Monsanto maliciously prosecuted Mr. Schmeiser, and stole six years of his life, among other things.

    Every farmer, every consumer has lost with this unjust ruling. The next step is to write clarity into the legislation to avoid further erosion of our collective rights by Corporate America.

    Vive le Canada…..Long live Canada.

    Vote if you have a defensible position, don’t just vote!
