Lumber Group Files Suit Against NAFTA

Posted on Thursday, September 15 at 09:48 by jensonj
UNCONSTITUTIONAL "The constitution does not permit these panels to be the final arbiter of whether U.S. law provides for relief from unfair subsidies and dumping for U.S. producers and workers," said Steve Swanson, the group's chairman. The lawsuit is the latest step in an ongoing dispute between the United States and Canada over steep U.S. tariffs imposed on imports of Canadian softwood lumber used in home construction. The tariffs, which average 27%, were put in place at the urging of the domestic lumber industry, which contended it was losing thousands of jobs because of unfair subsidies provided to Canadian producers. Canada's International Trade Minister Jim Peterson condemned the lawsuit and said Ottawa would defend its rights under NAFTA. "This is nothing more than a veiled attempt by the U.S. coalition to undo the softwood victories that Canada has achieved through the NAFTA," Peterson said. "We stand ready to vigorously defend the NAFTA and we will take all steps open to us to ensure it is respected." A spokeswoman for U.S. Trade Representative Rob Portman said he was still reviewing the complaint. "However, the United States firmly believes that the dispute settlement procedure in the NAFTA ... complies with the constitution," spokeswoman Neena Moorjani said in a statement. http://www.winnipegsun.com/Business/2005/09/14/pf-1215888.html [And a related link submitted by an Anon reader:] http://www.chicagotribune.com/business/chi-0509140136sep14,1,7735244.story

What nobody is talking about is the very real possibility that the supreme court eventually could find that NAFTA tribunals are exactly that-contrary to the constitution. Compare that with Canada where it was just found that the tribunals were unfair, secretive, against canadian interests, yet were NOT contrary to our constitution. Perhaps maybe one of our countries has a better constitution in this regard.

You could be right and maybe we should look at reconstructing the way we elect the "governing" party, maybe a little less power in the parties hands and more in the hands of the people, then we might not only get a stronger constituation , but stronger Canada.

So NAFTA is okay as long as the US is in control. It's against their constitution if the rules are not in their favour. Purhaps the only party in the NAFTA agreement should be the USA. Let them trade with themselves.

This lawsuit is about the best news I've hear on NAFTA since it raised its ugly head. An international treaty depriving citizens of their democratic decision making rights and handing it over to a special interest sector, disguised as a trading agreement.

This destruction of democracy applies to all 3 countries and the lawsuits should have long been done in all 3. Let's hope that in this case the Americans will lead the way and declare this whole NAFTA conspiracy unconstitutional. That would also kill the present GATS negotiations at the WTO , etc.

Wow! Just imagine the faces of our multinational corporate rulers and their bought and paid for politicians! I'm not a religious man, but this time I'll say a prayer that the lawsuit succeeds and we can make our own decisions once again. Ed Deak, Big Lake, BC.

Did it ever occur to any of you that scrapping Nafta might be just what the USA wants?

Anonymous,

any Party to the NAFTA can unilaterally abrogate it — six months later, poof! status quo ante. Go America! I know this is painful for some people but for your children's future, it's better that we are more self-sufficient. Going in this direction will lessen the infectious economic impacts of disasters in other countries. Too many people living in each other's pockets can be a bad thing.
