In March, a Federal Court justice upheld the security certificate on which he has been held, paving the way for Harkat's deportation to his native Algeria.
That decision was based extensively on confidential information and alleged evidence that has never been released to Harkat or his lawyers.
He's appealing to the Supreme Court and was seeking bail pending the outcome of that appeal.

Duh! Being found gulity by a Court of law means you have been convicted of the offense. Until you've been convicted, you are not guilty (see:adversarial system of justice). Since this guy hasn't even been *charged* he can't be *guilty*. And CSIS is never wrong *cough*Maher Arar*cough* are they?.
Just ask people who have been in jail for 10 years, convicted of a crime, then DNA evidence proves they were *innocent* all along.

Guilt is determined by a Court of Law, not public opinion. I always find it interesting how this emotion of 'smug' always seems to find it's way into the written word. It's pretty much become a keyword for those trolling Canadians, who have no other facts at their disposal.
