The flawed assumptions of NAFTA which will be discussed include: (a) that is was free trade, b) the asymmetry in the relationship c) Ch 11 which is contrary to our Charter and may be unconstitutional and was bound to create a race to the bottom in terms of the environment ( d) Ch 6 on Energy with its proportionality clause, and removal of Canada´s vital supply reserve e) that Water was not excluded from NAFTA (f) undemocratic decision-making mechanisms.
