Legalize Polygamy, Federal Study Urges

The paper by three law professors at Queen's University in Kingston, Ont., argues that Sec. 293 of the Criminal Code banning polygamy serves no useful purpose and in any case is rarely prosecuted. Instead, Canadian laws should be changed to better accommodate the problems of women in polygamous marriages, providing them clearer spousal support and inheritance rights.     But we all know that same-sex marriage would never open the door to legally recognized polygamy, bigamy, and so on...

    As far as it goes, polygamy itself doesn't hurt anyone, and really shouldn't be a crime. The problem, as the article points out, is that there are often other problems/abuses closely tied to polygamy.

    That said, I do agree that this goes against the arguments used for legalising gay marriage. I'm fairly certain that the polygamist population is far smaller than the gay/lesbian population.

    For a country that wants to separate the church from the government, our laws are still following that of the bible.

    The should legalise polygamy and create a new set of rules just like normal marriage.

    No, it wouldn't. But a *legal* challenge under the charter might. So if I'm a prudent government I'd gather legal opinions from across the spectrum of possiblity before writing policy (or worse, legislation) that doesn't anticipate it. I'd even do that if I was a conservative government planning to invoke notwithstanding and wanted to make sure my case was solid.

    Read the whole G&M article. There were other commissioned reports that took the opposite stance.

    The sad part is the B.C. violation is not being prosecuted under the existing law--though that is probably to avoid another charter rights challenge until the government's case is well informed (by reports like these).

    The constitutional challenge will clearly be based in freedom of religeon. Conservatives should be concerned because the approach to solution should not risk/weaken the charter right at the expense of the issue.

    It is much easier to deal with 2 or more women. If polygamy were legal that would be heaven on earth for me!

    Jesse come on. Polygamy is an abuse in itself. Polygamy should be a crime if you believe that Canada, founded as a nation by largely white protestants and French Catholics, deserves to exist.

    I would agree that polygamy should not be a crime in Iran, but this is Canada, and polygamy is not compatible with western societal structure, culture and values. Polygamy is a disgrace by western standards, even though it would help our birth rate it is a joke.

    You know it's funny Jesse that usually you are defending minorities against supposedly "intolerant" white males whereas this time when a minority group in Canada (Muslims) wants to treat their women like garbage you have no problem with it whatsoever. Talk about double standards.

    I do not favour feminism for Canada, but I do believe women deserve to be treated with respect. Polygamy is a no go IMO.
