Vince Li Not Criminally Responsible For Beheading

Posted on Tuesday, August 04 at 07:49 by RickW

Vince Li has been found not criminally responsible for the gruesome murder and beheading of Tim McLean on a Greyhound bus last summer because he is mentally ill.

Li's trial took only two days and heard from only two witnesses. Both were psychiatrists who testified Li suffers from schizophrenia. They testified Li heard what he thought was the voice of God
...

"He did not appreciate the act he committed was morally wrong. He believed he was acting in self defence and that he had been commanded by God to do so."

What this serves to confirm is the superstitious beliefs of the court.  The judges found Vince Li not guilty because ab ebtity called God told him to committ his heinous act. He is "obviously" insane because God surely would not tell one person to callously merder another (inspite of the revelations of the Old Testament).  This simply means that, given the acceptance by the court of this excuse as a reason to be found not guilty, the members of the court believe in the existence of God -- which cannot be proven in any court of law, and is therefore a piece of fiction that must be accepted strictly on belief, and not on points of law.  Would the verdict have been the same, if Vince Li said the person sitting in the seat next to him on the bus told him to commit this murder?

The case of the murder of Stefanie Rengel comes to mind:
http://network.nationalpost.com/np/blogs/toronto/archive/2009/03/03/girl-17-wanted-stefanie-rengel-dead-trial-hears.aspx
where the boyfriend (D.B.) of then 15-year old Melissa Todorovic was told by the latter to kill Stephanie, which he did by stabbing her several times and leaving her to die.

Yet, both D.B. and Todorovic have been convicted of murder.  In following the ruling of the court regarding Vince Li, why were neither of these people found not guilty by reason of insanity?  Or conversely, why weren't Both Vince Li and God found guilty of the murder of Timothy McLean?

The ONLY difference in the two cases is that one of the "defendants" happens to be a character called God, which cannot be brought before the court as Todorovic was, because the existence of God cannot be proven.  Would D.B. have been found not guilty by reason of insanity had Melissa Todorovic disappeared and not been found?  Or, was a subpoena issued, ordering God to testify before the court?  Whether God did or didn't is a matter of court record, and occording to this news article, there were only two witnesses, both of whom were psychiatrists (Yes, I know that some psychiatrists consider themselves to be God).

All of this serves to prove the bias of the court.  A biased court is an unreliable court, the judges should be sacked, and either D.B should be classified as insane, or Vince Li should be considered guilt of murder.

Vince Li is as a matter of fact guilty of murdering Timothy McLean regardless of his reasons why when considering the nature of his crime and the number of witnesses, there is no grey area here, and he belongs in prison, whether it's a special part for the criminally insane or whatever. And it is further a matter of fact that psychiatry is not a science and is completely subjective with no way of proving any diagnosis and completely lacking any objective evidence. For all we know this guy is just a truly evil person that saw a tv show where the "God told me to do it" defence was used and decided to give it a try...not one single person, other then Vince Li himself, can know for a fact what was in this guy's mind or whether this is what actually happened or not.

Jeffrey Dahmer was sentenced to prison for the murders he committed and there is no way anyone could ever suggest he was not mentally ill, it's a fact that murderers of this kind, who brutally kill innocent people, all are mentally ill but it doesn't change the fact that they are murderers and committed a crime and are a serious threat to society and therefore belong in prison. No one in their right mind would ever risk Hannibal Lector being set free...and that's exactly what they will be doing if they ever release this guy. You don't commit a crime like this and then get better and are all okay...this guy should never be released, ever, and anyone that would release him should be held fully responsible for any harm he causes after he is released, and should be forced to have to let him live with them the first 6 months at least after his release, to prove they believe he is not a threat to society any longer, and so if they are wrong they pay for their mistake.

I wonder if it had been the judge's son or daughter if his decision would have been the same, and I guess since the judge and these psychiatrists will never end up sitting on a bus next to Vince Li, since they can afford to never have to take a bus, that they don't have to worry about him being released back into society, clearly putting people at serious risk.

Our justice system is anything but just, it's corrupt, impotent and worthless.

I was just reading some of the comments under the news story linked above and someone made a very important observation...Li told the psychiatrists, according to them, that he was told by God to kill Tim while he was sitting next to Tim on the bus, that he had to kill Tim or Tim would kill him, yet why did Li buy and pack the combat knife and bring it with him much earlier, before he got on the bus and had ever met Tim, if the murder was not premeditated, and how would he have known then when he bought the knife and packed it that "God" was going to tell him to kill the young man that he was sitting next to on the bus before he had ever met him and that he was going to need the knife? Maybe someone can explain it to me because it looks pretty obvious based on what has been reported that the murder was premeditated and that Li lied about why he did it and when he decided to do it.

I agree with everyone above that Vince Li should be found guilty of murder, tossed in the darkest cell we have and throw away the key. I don't believe in the insanity defense, if only because I don't believe that we can ever be certain to have "cured" one of these individuals, and thus they can never be a functional member of society again. They are only a drain on resources that could be better spent elsewhere.

I will disagree that the courts were biased because "God surely would not tell one person to callously merder another ", and I will also disagree that this confirms "the superstitious beliefs of the court". The courts don't really care if you believe you are talking to God, Allah, or a dog. If you are having a conversation with an imaginary friend, deity, inanimate object or family pet, you are off your rocker. The difference between DB and Vince Li is that DB got his instructions as part of a conspiracy between himself and his girlfriend who planned and murdered Stephanie Rengel while Vince was talking to himself, unless God really does exist, in which case I'm FUBAR.

I think it is a stretch to think that the courts think that God is good, therefore you are insane to say that God told you to do something bad. The courts think Vince is a brick short of a load because he thinks he talks to God period. The Son of Sam was wacko as well, and he was talking to his neighbors dog (named Sam). They didn't subpoena the dog in that trial as a witness either - a pyschiatrist was sufficient in that case as well.

Narcissists and sociopaths are considered by health professionals to be mentally ill and they don't believe there is anything morally wrong with their criminal behavior, so should we let them off the hook too? That would probably cover the majority of the people sitting in jail right now.

Some cultures and religions believe that honour killings are acceptable and serve their God and that it's acceptable to rape women...should we also let those that commit these crimes off the hook because they don't believe what they are doing is morally wrong and believe they are serving their God and religious beliefs?

I seriously disagree with the mental health advocates and supporters that believe this decision is a good one and helpful to those suffering with mental illness as not all people who suffer with mental illness commit crimes and are dangerous to others and go around cutting off innocent young men's heads and eating them, in fact most don't, not even when they don't take their medication...so to lump this monster in with others suffering with mental illness and suggest he is no different only causes people to fear those suffering with mental illness and to want to have nothing to do with anyone that suffers with mental illness because if Li is no different from anyone suffering from mental illness then anyone suffering from mental illness could do what he did and that is horrifying and seriously untrue.

And as far as giving Li consideration and understanding because he is mentally ill...where is Tim's consideration and understanding and why does his rights and consideration for him and his life not come before any consideration for the man that horrifically brutally murderered him for no reason and then ate him in front of many witnesses. The victim's rights should come first and society's rights, including the right to know this man will never be free to hurt anyone else ever again, and that they can sit on a bus or out in public without fearing that someone will suddenly brutally kill them for no reason and eat them because they weren't taking their medication or following through with their treatment or whatever.

And I also would like to know why the police stood by for so long before they took action to capture Li...an innocent, tired and confused man in an airport that didn't hurt anyone they immediately zap and kill, but an obvious murderer eating his innocent victim they patiently sit by and let do what he pleases for an extented period of time before they take action. Nobody would have been upset if the police had zapped Li or shot him and killed him considering what he did, in fact most people would have been relieved and felt safer and that as close to justice as possible had been done, unlike the miscarriage of justice that has now added insult to injury and left us all worried about where this guy will ultimately end up and praying it won't be next to us or someone we love.

The (collective) court obviously thinks there is a difference for it to issue two different verdicts. The ONLY difference is that one party is corporeal and the other, incorporeal (as far as we know). But it allows tacit recognition of the existence of God, in that, when and if one is in communication with said God and commits a crime, one must necessarily be insane.

How about that Joan d'Arc person anyway? She was obviously insane, hearing as she did voices, then committing mass murder in the name of God.

BTW, I AM in agreement with you that VI should be executed....

    Dear RickW,

I am sending you a line if you are still in this forum and also for those who believe(d) the same about 'Joan d'Arc':

First of all, she was not 'obviously insane', and only insane to your own mind because you did not look with your faith but with too much pride.

Joan of Arc was born to save France from the attacks of English army and if it not be for her, France would not have been saved by her. She indeed received councel from Saint Michael the Archangel for one, as well as Saint Catherine for two and Saint Margaret for three. Is it because you can't hear voices yourself that you believe that one can not hear voices from heaven?

Second of all, you have no evidence that Joan of Arc committed mass murder. It's not like she picked up a sword and killed all the english who attacked France... hello RickW, anyone home???

In fact, Joan of Arc did not kill any one herself. She was given charge to command an army against the English... the English at that time were the ones committing mass murder upon France and NOT the other way around.

So, look behind you properly next time before you pass improper judgment on someone you don't even know.

And to correct your grammar error, her name is Saint Joan of Arc and better yet, Sainte J?hanne de l'Arc.

Calling her a mass murderer is like accusing Moses of the same. And Moses by the way was allowed to kill in the name of God and is well and fine in heaven where he belongs along with Saint Joan of Arc as well.

    History Lesson over...

I'd just like to add that if this is the case who can we hold responsable for an unmedicated phsycopath roaming the country. There need to be sweeping changes to the mental health act in this country to give doctors power to commit these people to institutions before they commit such ghastly crimes.
Li was treated for schitzophrenia prior to his actions and refused additional treatment. people like him are too frequently left to their own devices and allowed to mix with the rest of us becoming proverbial powder kegs waiting to explode, it may take a month it may take 10 years but eventually....Bang as in this case.

I have first hand experience as a Family Mamber has the same illness as Li, he is also unmedicated and refuses to admit at this point that he has a problem, he admits to hearing voices and hallucinating and blames it on the meds that he had to take when he was an in-patient. Because he is an adult no one can do anything to keep him from harming himself or others and it's only a matter of time, I'm afraid that one day I will wake up to see him as a news story.
