Julian Falconer, Arar's lawyer in the civil action, said there were discussions between the parties.
"To date, there has been no offer of compensation to Mr. Arar, but there is ongoing and very useful dialogue," he said.
Formal mediation sessions are still slated for mid-January, he added.
Day's support for Zaccardelli came as a Toronto newspaper reported that he had played down the Arar inquiry's criticisms of his force and told his officers in a memo that he was "proud" of they way they conducted themselves throughout the inquiry.
