The groups’ judicial application seeks a declaration by the Court that NAFTA investor-state procedures are unconstitutional because they: undermine the independence of Canadian courts by improperly delegating authority to adjudicate matters reserved to them by the Constitution Act; infringe the rights and freedoms guaranteed by the Charter; exceed the treaty making powers of the federal government; and violate the rule of law.

Evidence has now been filed in the case in the form of affidavits sworn by three renowned experts in their fields.

This is very good news, even if the outcome remains uncertain and far into the future. It is gratifying that there are still people out there who are doing something to challenge the NAFTA, which many see as a very bad deal for ordinary Canadians. I wish them well, and I hope they and others will keep up the good work. Regardless of how this initiative turns out, I hope they seek new and innovative ways to keep the pressure on. I believe they are right, and ultimately some success will be theirs if they persist.

It is very worrying that I have seen or heard little or nothing about this challenge in any mainstream media. There may have been some minor coverage somewhere that I missed, but it certainly wasn't very prominent. This underlines my concern that these media appear to cover news items selectively. Those that best serve the corporate or personal agendas of media owners recieve major attention, those that do not often recieve very little, are treated in a negative fashion or are ignored altogether. This is tantamount to censorship, and stifles badly needed debate in Canada on a whole host of important issues. Combine this with the universally right wing bent of almost every mainstream editorialist in the country, and you can forgive the growing number of Canadians who worry that their media have become instruments of propaganda rather than of public information. Does anyone have any workable ideas of what might be done about that very significant problem? Thank God at least for Vive le Canada!

I don't think that should really surprise people. If you don't think that a multi-billion dollar organization that owns a media chain has an agenda you've gotta be delusional!
